1. Acceptance of Terms
By accessing or using DockCall ("the Service"), operated by DockCall LLC ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
DockCall is a cloud-based platform that enables warehouse facilities to manage freight driver check-ins via SMS. The Service includes:
- SMS-based driver check-in and queue management
- Real-time warehouse dashboard for door assignments
- Automated text message notifications to drivers
- Statistics, reporting, and operational tools
3. Account Registration
To use the Service, you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes related to warehouse and logistics operations. You shall not:
- Send unsolicited or spam messages through the Service
- Use the Service to harass, abuse, or harm any person
- Attempt to gain unauthorized access to any part of the Service
- Use the Service in violation of any applicable law or regulation, including the Telephone Consumer Protection Act (TCPA)
- Share your account credentials with unauthorized parties
5. SMS Messaging
The Service sends SMS messages to freight drivers on behalf of your organization. By using the Service, you acknowledge and agree that:
- Drivers must initiate contact by texting your assigned number (opt-in)
- Messages are transactional in nature (check-in confirmations, door assignments)
- Standard message and data rates may apply to drivers
- Drivers may opt out at any time by texting STOP
6. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications to the Service at any time. We are not liable for any downtime or service interruptions.
7. Payment and Billing
Pricing is based on your organization's plan tier, determined by the number of dock doors configured. Payment terms will be communicated at the time of account activation. We reserve the right to modify pricing with 30 days' notice.
8. Data Ownership
You retain ownership of all data you input into the Service, including driver check-in records, door configurations, and business settings. We do not claim ownership of your data. Upon account termination, you may request export of your data within 30 days.
9. Limitation of Liability
To the maximum extent permitted by law, DockCall LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
10. Termination
Either party may terminate the service relationship at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your access to the Service will cease and your data will be retained for 30 days before deletion.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the updated Terms.
